Terms of Service

These Terms govern your use of Portapfolio: the mobile app, the website at portapfolio.com, and the public pages we host for you. By creating an account or using the service you agree to them. If you don't agree, don't use the service.

The short version

This summary is here so you can understand the deal without reading every clause. It isn't a substitute for the rest of the document, and where they differ, the full clauses govern.

  • Your work stays yours. You keep ownership of every photo and every word you upload. You give us only the permission we need to store your content and show it on the page you asked us to publish.
  • You are responsible for what you upload. Only upload work you made or have permission to use.
  • Paid plans renew automatically until you cancel. Apple or Google bills you, and you cancel through them, not through us.
  • We can remove content and suspend accounts that break these rules, and we will do so for copyright infringement.
  • You can delete your account at any time from inside the app, and that deletes your content.
  • You must be at least 18 to use Portapfolio.

What the service does

Portapfolio lets you build one or more portfolios of images with captions and contact details, and publish them as a public web page at an address we assign or that you choose. You can share that page by NFC tap, QR code or link, present it full screen in person, and export it as a PDF.

We try to keep the service available but we don't guarantee uninterrupted access. We may change, add or remove features. If we remove something you were relying on and it materially reduces what you paid for, you may cancel and we'll refund the unused part of a prepaid term.

Keep your own copies of your photos. Every service can lose data, and the app is not a backup.

Your account

You must be at least 18 years old. The app creates an anonymous account on first launch so you can try it; to publish a public page you must add a verified email address, because a public page needs an owner we can contact.

You are responsible for activity on your account. Tell us promptly at rogelio.robledo.9313@gmail.com if you think someone else has access to it.

Your page is hosted at an address on portapfolio.com, such as portapfolio.com/u/yourname. We do not register, sell or transfer a domain name to you, and no plan includes one. If you want a domain of your own, you buy it from a registrar, and it stays yours whatever happens to us.

Handles (the name in that address) are assigned on a first-come basis and remain ours to license, not yours to own. We may reclaim a handle that impersonates someone, infringes a trademark, or belongs to an account that has been inactive for an extended period. If we reclaim yours, we'll tell you first unless a legal claim requires us to act immediately.

We may change the structure of page addresses if we need to. If that changes yours, we'll keep the old address working by redirecting it, because printed cards and NFC tags carry addresses we can't reach out and update.

Your content, and the permission you give us

You keep all ownership of everything you upload: photos, titles, captions, descriptions, your bio and your contact details ("Your Content"). Nothing in these Terms transfers ownership of Your Content to us.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, transmit and publicly display Your Content, solely to operate the service: to show it to visitors of the page you published, to generate the sizes and PDFs the product needs, and to keep backups. This licence exists only so we can do what you asked us to do, and it ends when you delete the content or your account, apart from copies in routine backups which age out.

We do not use Your Content to advertise Portapfolio, and we do not use it to train machine learning models. If we ever want to feature your work in our own marketing, we'll ask you first and you can say no.

You promise that you own Your Content or have all the rights needed to upload and publish it, and that publishing it doesn't infringe anyone's copyright, trademark, privacy or publicity rights. This matters more in this product than in most: if you photograph people, or reproduce someone else's design, artwork or tattoo, getting permission is your responsibility, not ours.

What you may not publish

You may not use Portapfolio to upload, publish or share content that:

  • infringes anyone's copyright, trademark or other intellectual property;
  • is sexually explicit, or sexualises a minor in any way;
  • depicts or promotes violence, self-harm, terrorism or the abuse of any person or animal;
  • is gratuitously graphic or gory, including depictions of death, serious injury, mutilation or cruelty;
  • depicts, promotes or offers firearms, ammunition, explosives, other weapons, or instructions for making them;
  • depicts, promotes or offers illegal drugs, controlled substances, drug paraphernalia, or the misuse of legal substances;
  • harasses, threatens, defames or impersonates any person;
  • promotes hatred against people based on race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation;
  • contains another person's private information, or an identifiable person's image, without their permission;
  • is unlawful where you are or where it is published, or promotes unlawful activity;
  • is spam, a scam, phishing, malware, or a bulk-created page with no genuine portfolio in it.

The list above is not exhaustive. Portapfolio is a service for publishing professional portfolios, and we may also remove content, unpublish a page or close an account where we reasonably consider the content unsuitable for that purpose, or harmful to the service, to other users, or to our reputation — even where the content is lawful and not specifically named above. We exercise this judgement sparingly and, where it's reasonable to do so, we'll tell you what we removed and why.

You also may not attempt to break, overload, scrape or reverse engineer the service, probe or test its security, bypass any limit, quota or paid feature, access another person's account or content, or use the service to attack anyone else. Nor may you use it to build a competing product.

Anyone can report a page. Use the Contact page or write to rogelio.robledo.9313@gmail.com with the address of the page and what's wrong with it. We aim to review every report within 24 hours and will remove content and suspend accounts where these rules are broken. We can act without notice where the content is clearly illegal or where someone is at risk.

Trademark, privacy and other rights complaints

The DMCA process above applies to copyright. It does not cover everything, so this is the route for the rest: a trademark you own being used on someone's page, your photograph of a person published without their consent, your name or likeness used to promote a business that isn't yours, or private information about you that shouldn't be there.

Write to rogelio.robledo.9313@gmail.com with the address of the page, what specifically is wrong, what right you hold and how you hold it, and how we can reach you. We aim to review every report within 24 hours. Where a claim is clear we remove the content and tell the person who posted it. Where it's genuinely contested between two parties, we may keep the content offline while we ask both sides for more, because leaving it up is the harder position to reverse.

We act on notice. If you believe something on Portapfolio infringes your rights, tell us rather than assuming we've seen it. Nobody at Portapfolio reviews pages before they are published.

We keep a record of every report and what we did about it. Accounts that attract repeated valid complaints are suspended on the same basis as repeat copyright infringers.

Plans, billing and renewal

Portapfolio has a Free plan and a paid Pro plan. What each one includes is described on the Pricing page and inside the app. We may change what's included, with notice.

Pro is an auto-renewing subscription. It renews for the same period at the same price unless you cancel at least 24 hours before the current period ends. Your store account is charged within 24 hours of the renewal date.

Subscriptions are sold through the Apple App Store or Google Play, not by us directly. That has three consequences worth knowing. The store takes payment, so we never see your card details. The price you're shown at purchase is the price in your store account's country, including any local tax, and it is the amount that governs, not any figure on our marketing pages. And you manage or cancel the subscription in your store account settings, not in our app; we cannot cancel it for you.

Cancelling stops the next renewal. It does not end the period you've already paid for: Pro features stay on until that period expires, and we don't pro-rate a partial period.

Refunds are handled by Apple or Google under their own policies, because they took the payment. Where the law where you live gives you a refund or withdrawal right, that right applies regardless of anything in this section. If we materially reduce what Pro includes, or raise the price, we'll notify you before it takes effect and you can cancel.

If a subscription ends, your content is not deleted. Anything above the Free plan's limits becomes hidden rather than removed, and reappears if you subscribe again.

Our intellectual property

The app, the website, our name, our logo and everything we designed remain ours. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the service while your account is active. That licence doesn't let you copy our designs, resell access, or use our brand without written permission.

Suspension, termination and deletion

You can stop using Portapfolio at any time, unpublish your page from inside the app, and close your account from the app's settings. Closing your account deletes your profile, your portfolios and your photos from the live service; residual copies in encrypted backups age out on the normal backup cycle.

Two things happen that are worth knowing before you do it. Your handle is released and may be claimed by someone else, so links, QR codes and NFC tags already printed with it will stop leading to you and may in time lead to a different person's page. And your public page may stay visible for up to an hour afterwards while content delivery caches expire.

Closing your account does not cancel your subscription. Subscriptions are billed by Apple or Google, not by us, and we have no ability to cancel them on your behalf. If you have an active subscription, cancel it through the App Store or Google Play first — otherwise you will continue to be charged after your account is gone. We do not refund unused time.

Closing your account is permanent. We cannot restore it or recover your work. We keep a limited record of the closure where the law requires it, described in the Privacy Policy.

We may suspend or terminate an account that breaks these Terms, that we're legally required to act on, or that puts other people or the service at risk. Where it's reasonable to do so we'll tell you why and give you a chance to fix it. Where we terminate for a breach you caused, prepaid fees are not refunded except where the law requires it. We may also decline to open a new account for someone whose account we closed for a breach.

Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that it will meet your requirements.

We don't review, endorse or take responsibility for content published by users, and we're not responsible for third-party services the product depends on or links to.

Nothing here excludes any right you have under consumer protection law that cannot legally be excluded. If a clause in this document conflicts with such a right, that right wins and the rest of the document still stands.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, or lost or corrupted data, however caused.

Our total liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.

We are not liable for failures or delays caused by events outside our reasonable control, including outages at the hosting, storage, payment or app-store providers this service depends on, network failures, or acts of government.

These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or wilful misconduct.

As above, nothing in this section removes a right you have under consumer protection law that cannot legally be removed. Where such a right applies, it applies regardless of the limits set out here.

General

If any clause here is found unenforceable, it is narrowed to the minimum extent needed and the rest continues in force. Our not enforcing a clause on one occasion doesn't waive it. You may not assign these Terms; we may assign them as part of a merger, acquisition or sale of assets. These Terms are governed by the laws of Mexico, without regard to conflict of law rules, and this does not deprive you of the protection of mandatory consumer law where you live.

"You" means the person using the service, or, where the service is used on behalf of a business, someone authorised to accept these Terms for that business. The service itself is operated by Rogelio Robledo Ruiz ("we", "us", "our"), at Av. Insurgentes Sur 1425, 1006, Mexico City, Mexico 03920. Before starting formal proceedings against us, write to rogelio.robledo.9313@gmail.com so we can try to resolve the matter directly first — most things are fixable in an email, and that address also reaches us for anything else this document doesn't give a more specific one for.

This document is published in English and in Spanish, and the two are the same agreement rather than two different ones: whichever you read, the version number and the effective date are the same, and accepting one accepts the other. Translation is never exact, so if a genuine discrepancy between the two ever changes the meaning of a clause, the Spanish text governs for users located in Mexico and the English text governs everywhere else.

Your indemnity

You agree to indemnify and hold us harmless from claims, damages, losses and reasonable legal costs arising from Your Content, your use of the service, or your breach of these Terms. This is the clause that matters most in practice: if someone claims a photo on your page infringes their rights, that claim is yours to answer.

If you use the iOS app

These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.

If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to meet a legal or regulatory requirement, claims under consumer protection law, and any third-party claim that the app infringes intellectual property rights.

You confirm you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to these Terms

We may update these Terms. If a change materially affects your rights we'll give you reasonable notice by email or in the app before it takes effect. Continuing to use the service after that means you accept the change. If you don't accept it, cancel and stop using the service.
